Role Description
Real is seeking a Fintech Product & Regulatory Counsel to join our Legal team. This role will be instrumental in advising on legal and regulatory risks associated with the company’s financial products, specifically supporting Real Wallet and One Real Mortgage, a subsidiary of Real Brokerage. You will navigate the complex regulatory landscape of both fintech and mortgage services, ensuring compliance while enabling innovation and business growth.
- Provide guidance to product and business teams throughout the product development lifecycle, ensuring compliance with applicable legal and regulatory requirements.
- Proactively identify potential legal and regulatory risks and collaborate with business partners to propose practical, business-focused solutions.
- Draft, review, and negotiate commercial agreements that support product development and enterprise-wide initiatives.
- Stay updated on the latest laws, regulations, and trends within the fintech and financial services industries, particularly consumer protection laws.
- Work closely with the marketing and go-to-market teams to ensure that all consumer-facing materials and campaigns comply with legal and regulatory standards.
- Partner with the broader Legal & Compliance team on various corporate and enterprise-wide initiatives as needed.
Qualifications
- Strong understanding of regulatory compliance, particularly within the fintech and embedded finance sectors.
- In-depth knowledge of consumer protection laws and regulations, including but not limited to TILA, RESPA, ECOA, FCRA, BSA/AML, UDAAP, and GLBA.
- Ability to anticipate, identify, and address legal and regulatory risks specific to embedded financial products (e.g., Banking-as-a-Service (BaaS), digital wallets, lending, payments).
- Experience drafting and negotiating complex commercial agreements specific to fintech and embedded financial products, such as Banking-as-a-Service (BaaS), payments, lending, or digital wallets.
- Familiarity with third-party fintech partnerships and working with banks, payment processors, and regulatory bodies to ensure compliance.
- A strong willingness to learn new technology and the digital tools used within the fintech and embedded finance space. Digital fluency or the ability to quickly understand tech concepts is essential.
- Experience working with cross-functional teams, including product, engineering, compliance, and marketing, to align legal strategy with business goals.
Requirements
- Juris Doctor (JD) from an accredited law school.
- 10+ years of experience in a law firm or in-house legal department, with significant hands-on experience advising on regulatory compliance for fintech, embedded finance, or digital financial services.
- Proven experience working directly with product and engineering teams to support product development, ensure regulatory compliance, and drive innovation is a requirement.
- Practical experience with consumer protection laws, including TILA, RESPA, ECOA, FCRA, BSA/AML, UDAAP, and GLBA, as they relate to fintech and embedded finance.
- Any relevant certifications (e.g., Certified Regulatory Compliance Manager (CRCM), fintech law certifications, bar admissions, or other regulatory qualifications).
