[Hiring] Vice President and Associate General Counsel, Litigation @Kindred Healthcare

Role Description

The Associate General Counsel, Litigation, is responsible for leading the litigation department and managing all aspects of potential or pending litigation matters and investigations for the Company, including:

• Retaining and managing outside counsel and other third-party experts
• Assisting with and overseeing any electronic and other discovery
• Conducting internal investigations into the factual basis for any litigation or investigation
• Communicating and collaborating with operators and other business partners about any litigation or investigation
• Devising and implementing strategies to prevent similar litigation matters and investigations
• Communicating with opposing counsel and/or government investigators
• Recommending and negotiating any necessary settlements of any litigation or investigation

The Associate General Counsel, Litigation, will report directly to the General Counsel and provide ongoing and proactive legal guidance related to a broad range of pre-litigation and litigation matters, including:

• Labor and employment
• General business disputes
• Class and collective actions
• Professional liability matters/medical malpractice claims

The ideal candidate will provide general advice and counsel to ensure the company is complying with applicable policies, regulations, and laws, by maintaining an in-depth working knowledge of those policies, regulations, and laws, as well as having collaborative and constant communications with other attorneys within the Legal Department and other business partners within the Company.

Qualifications

• Deep knowledge of employment law (FLSA, ADA, FMLA, Title VII, wage & hour)
• Strong ability to develop and implement strategic legal approaches to manage risk and resolve disputes
• Skilled in managing outside counsel, legal budgets, and internal litigation support functions
• Excellent communication and interpersonal skills, with the ability to influence and advise senior leadership
• Proven experience conducting internal investigations and handling government inquiries
• Effective in representing the company at mediations, arbitrations, and court proceedings
• Proficiency in managing discovery, e-discovery, litigation holds, and records compliance
• Capable of delivering legal training and promoting compliance across the organization
• High level of discretion, integrity, and professionalism in handling sensitive matters
• Ability to manage multiple complex legal issues

Requirements

• Doctorate (Professional or Academic) Juris Doctor (required)
• 9+ years progressive litigation or litigation management experience with an emphasis in labor and employment law, general and professional liability claims or equivalent (required)
