Role Description
Reporting into the Legal Director β Global Privacy and Data Protection, the Counsel - Privacy and Data Protection is responsible for:

Identifying, monitoring and advising on new legislation and regulations relating to privacy, data protection, cybersecurity, artificial intelligence, and automated decision-making.

Supporting contract negotiations and drafting and maintaining data protection and artificial intelligence contract template terms and related guidance materials.

Reviewing business initiatives and advising on alignment with applicable legal requirements.

Advising the marketing organization on applicable privacy and artificial intelligence requirements.

Advising on incident response activities.

Developing internal training and guidance materials.
This role will support the enterprise globally in all jurisdictions in which WEX operates.
How you'll make an impact

Horizon scanning, monitoring and advising on changes or developments in global privacy and data protection, artificial intelligence, automated decision-making, and cybersecurity laws and regulations that may impact WEX.

Advising on best practices and compliance with privacy and data protection, artificial intelligence, automated decision-making, and cybersecurity laws globally with primary accountability for Canada, Brazil, India, Singapore, and Australia.

Advising the commercial legal teams on the negotiation of privacy, data security, and artificial intelligence terms in contracts and drafting and maintaining related contract templates and guidance documents.

Assisting the third party assurance team on customer questions relating to privacy and AI practices.

Participating in the review of new business and commercial initiatives for privacy, cybersecurity, and artificial intelligence legal risks.

Advising the marketing team on privacy and AI matters relating to marketing campaigns and cookie compliance obligations.

Participating on cross-functional teams to advise on the development, updating, and maintenance of policies and procedures relating to privacy, data protection, cybersecurity, and artificial intelligence.

Maintaining an understanding of relevant laws, regulations, industry standards, and policy trends relevant to WEX products and technology.

Counseling other members of the WEX legal team regarding privacy and data protection matters in various types of agreements, including software (and cloud/SaaS), data license, and professional services agreements.

Coordinating cross-functionally, and with outside counsel in domestic and international markets, on issues related to data privacy, cybersecurity, and artificial intelligence.

Independently and in collaboration with the Privacy Compliance team, developing training materials and conducting training sessions for product and business teams.
Qualifications

Juris Doctor degree or equivalent.

Qualified lawyer admitted to practice in at least one U.S. state.

2-4 post qualification experience in privacy and data protection, cybersecurity and incident response, artificial intelligence, and transactional/contract negotiation.

Experience advising on laws and regulations relating to privacy, data security, and artificial intelligence, including HIPAA, GLBA, and state and national privacy and AI laws.

In-house legal experience preferred.

Financial services and/or healthcare or similar regulated industry experience preferred.

Excellent communication (oral and written) and interpersonal skills.

Exceptional organizational skills, attention to detail, and the ability to multitask, prioritize, and adjust as priorities shift.

Strong reviewing and drafting skills; commitment to quality through demonstrated accuracy and thoroughness.

Ability to be team-oriented and collaborative.

Ability to build strong internal relationships and to act as a legal resource for business and functional leaders globally.

Proficiency in Microsoft Office and G-Suite; ability to ramp up quickly on other applications and systems, including document management systems.

Must successfully pass a background investigation.

Pay Range
$136,900.00 - $163,400.00
