[Hiring] Assistant General Counsel, Derivatives – Regulatory Legal @Kraken

Role Description

Join our Product and Regulatory Legal team, embedded with Kraken’s Product, Design, and Engineering teams to ship novel products and experiences that accelerate the global adoption of crypto. This person would serve as the primary internal expert on Commodity Futures Trading Commission (CFTC) regulation and Commodity Exchange Act (CEA) compliance.

• Own Payward’s regulatory relationships and compliance posture across its portfolio of CFTC-registered and regulated entities, including a Designated Contract Market (DCM), a Derivatives Clearing Organization (DCO), and a Futures Commission Merchant (FCM).
• Serve as the lead legal adviser on all matters touching Payward’s CFTC-regulated entities.
• Manage and coordinate with outside counsel on regulatory matters before the CFTC and National Futures Association (NFA).

Qualifications

• Qualified attorney admitted to practice law in the United States.
• 12+ years of experience in financial services law with a strong concentration in CFTC regulation and CEA-registered entities.
• Deep substantive knowledge of the CEA and CFTC regulations.
• Familiarity with CEA Section 2(c)(2)(D) and the CFTC's jurisdiction over leveraged, margined, or financed retail commodity transactions.
• Direct experience advising on, preparing, or managing CFTC regulatory filings, rule submissions, or examination responses.
• Outstanding analytical, drafting, and organisational skills.
• Ability to translate complex regulatory requirements into practical product and operational guidance.
• Authentic interest in crypto and digital assets.
• Familiarity with using AI tools such as Enterprise GPTs.

Requirements

• Experience advising on CFTC oversight of digital asset derivatives.
• Experience with swap dealer registration and the uncleared margin rules under the CEA.
• Knowledge of NFA compliance programme requirements.
• Familiarity with non-US derivatives regulatory frameworks.
