Role Description

This role will be responsible for providing legal services and advice to the Sybrin Group of Companies. This covers various aspects, such as:

  • Contracting
  • Legal opinions
  • Company secretarial
  • Data protection
  • Trademark registration
  • BEE audit
  • Company policies
  • Debt collection

Qualifications

  • Minimum of 8-10 years’ experience
  • Bachelor’s degree – LLB
  • Knowledge of ISO 9001 and ISO 27001 standards
  • Knowledge of GDPR

Requirements

  • Deliver legal advice across a variety of legal topics, including contract law, intellectual property rights protection and ownership, labour law, corporate governance and data protection
  • Draft, vet and negotiate supplier agreements, software licensing agreements, software development agreements, partner agreements, reseller agreements, teaming agreements, service level agreements, implementation agreements, data protection agreements, non-disclosure agreements (NDA) and property lease agreements
  • Ensure ongoing POPIA compliance
  • Appointed PAIA Information Officer (Promotion of Access to Information Act)
  • Coordinate with external attorneys to manage litigation matters and trademark registrations
  • Handle shareholder enquiries regarding corporate governance
  • Company secretarial matters, such as drafting resolutions and board meeting minutes, director changes, updating internal databases, and filing annual returns with the CIPC
  • Drafting and vetting of company policies
  • Assist with B-BBEE compliance and audits
  • Exchange Control application and compliance with regulations
  • Conduct risk assessments and data protection impact assessments (DPIAs) as necessary for high-risk processing activities
  • Implement data breach response protocols, managing incidents, and ensuring timely notification and resolution of breaches
  • Develop, implement, and enforce policies and procedures for data protection compliance across the organization
  • Monitor ongoing compliance with relevant data protection laws and regulations, including GDPR, or other applicable standards
  • Work closely with other departments to align data privacy and security strategies
  • Advise on data protection implications of new projects, services, or initiatives and ensure data privacy is integrated from the outset

Reporting Line

  • Junior Legal Advisor reports into this role
  • Direct report into CFO
  • Data Protection report into CEO

Critical Technical and Behavioral Skills Required

  • Strong knowledge of commercial, contract, and corporate law
  • Excellent negotiation, drafting, and analytical skills
  • Ability to communicate complex legal information effectively to non-legal stakeholders
  • Proactive problem-solving approach and strong attention to detail
  • High level of integrity, confidentiality, and professional ethics
