Role Description

This position serves as a Resident Agent in Madison, WI, reporting to Regional Office 18 Minneapolis, in Minneapolis, Minnesota, of the National Labor Relations Board. The primary purpose of this position is to investigate and handle representation cases (R cases) and a variety of unfair labor practice cases (C cases) including the most complex cases.

As a Labor Management Relations Examiner (Resident Agent), GS-0244-13, your typical work assignments may include:

  • Applying analytical abilities necessary to recognize issues that arise during an interview with witnesses and asking follow-up questions to obtain further information from the witness as well as securing documentary evidence.
  • Managing difficult/special cases with independence and substantial negotiating authority; handling urgent cases requiring on-the-spot decisions.
  • Interviewing parties and witnesses in unfair labor practice cases and taking affidavits as to the facts related to the allegations.
  • Furnishing information and pre-filing assistance to representatives of labor and management, attorneys, employees and the general public as to the Act and their rights and obligations under the Act, the Board's Rules and Regulations and Statements of Procedure.
  • Drafting a final investigative report or agenda outline setting forth the facts of the case and a recommendation as to the proper course of action in the case.

Qualifications

  • Substantial experience investigating and handling complex representation and unfair labor practice cases under the National Labor Relations Act.
  • Strong analytical and legal research skills.
  • Excellence in negotiating and resolving disputes.
  • Ability to manage cases independently with minimal supervision.
  • Effective communication and impartiality.
  • Ability to work tactfully with parties holding divergent views.
  • Familiarity with Board law, collective bargaining, and labor-management relations is highly desired.
  • Flexibility and willingness to travel as needed to fulfill job responsibilities.

Requirements

  • One year of specialized experience, equivalent to the GS-12 grade level, which has provided the knowledge, skills, and abilities to successfully perform the duties of a Labor Management Relations Examiner (Resident Agent) at the GS-13 grade level.
  • Experience conducting investigations in unfair labor practice and representation cases, including interviewing parties and witnesses, taking affidavits, analyzing legal and factual issues, and preparing detailed investigative reports with recommended case dispositions, consistent with established Board law and procedures.
  • Experience applying the National Labor Relations Act, Board and court decisions, and related statutes to evaluate the merits of charges or petitions, negotiate voluntary settlements, compute remedies such as backpay, and recommend whether further action such as dismissals, complaints, or injunction proceedings is warranted.
  • Experience managing complex cases with a high degree of independence, making on-the-spot decisions, resolving disputes in adversarial settings, and exercising sound judgment when dealing with antagonistic parties, novel legal issues, or accelerated timelines.
